Last amendment on 11 December 2023
The Dutch government is tackling litter by restricting the use of plastic disposable products – the so-called SUP legislation. SUP stands for Single Use Plastic. From 1 January 2024, disposable plastic-containing cups and meal trays will be banned for consumption on the premises unless high-quality recycling standards can be met. There has already been a ban on supplying disposable plastic-containing cups and meal trays free of charge for consumption on the go, collection and delivery since 1 July 2023.
Ban on disposable plastic cups and meal packs for consumption on the premises
From 2024 the SUP Law will be extended to cover consumption on the premises, for example in bars and restaurants, at events and in offices. From then on, providing disposable plastic or plastic-containing cups and meal containers will be banned unless you ensure proper collection of these products for effective recycling. This type of recycling is currently only possible for PET products, so packaging made from other materials can no longer be used from 2024 for on-premises consumption, even if they are charged separately.
Discouraging disposable plastic cups and meal packs for consumption on the go
Since 1 July 2023, the current SUP legislation has been expanded. It is now forbidden to provide free plastic or plastic-containing disposable cups and meal packaging for consumption on the go, or for collection and delivery. You may still provide this plastic packaging if the consumer pays extra for it. This rule therefore falls under the discouragement policy and not under the ban on use. In addition, you are obliged to offer the consumer a reusable alternative or to encourage the “bring-your-own”principle. This means allowing customers to bring their own mugs, plates or containers.

The ban on SUP products and the marking of SUP products
Since 2021 there has been both a ban and mandatory marking on SUP products. The ban applies to a number of plastic disposable products such as cutlery, stirrers, plates, pre-foamed polystyrene meal containers, and polystyrene drinking cups with lids. Mandatory marking applies to disposable cups with a plastic coating or that are made entirely out of plastic. This marking identifies the product as being made of plastic or containing plastic.
Why this new legislation?
With the SUP legislation, the EU wants to reduce the volume of plastic litter. This is desperately needed, because the negative effects on the environment are huge. *The term plastic-free packaging means packaging that does not use polymers (plastics) to make the product water and/or grease proof, as described in the Dutch legislation on Single Use Plastics.
1 juli 2021
Per 1 juli 2021 zit er in Nederland statiegeld op alle PET-flessen voor frisdrank en water tot drie liter.
3 juli 2021
Vanaf 3 juli 2021 is de SUP-richtlijn van kracht en gelden in de Europese Unie nieuwe regels voor het 2023 gebruik van plastic wegwerpproducten.
2023
Er komt in Nederland een verbod op het gratis verstrekken van plastic-bevattende drankverpakkingen voor eenmalig gebruik met als doel het verbruik van dit soort verpakkingen blijvend te verminderen. Deze maatregel is vergelijkbaar met het verbod op het weggeven van plastic tasjes. Naar verwachting gaat de maatregel in 2023 in.
5 januari 2023
Vanaf 5 januari 2023 is er een nieuwe, uitgebreide producenten-verantwoordelijkheid die bepaalt dat producenten de kosten dragen voor het opruimen van bepaalde soorten zwerfafval:
- Eenpersoons verpakkingen van voedsel dat bestemd is voor directe consumptie, zoals saladeschaaltjes en hamburgerbakjes;
- Zakjes en wikkels waaruit de consument direct kan eten (wikkels van snoeprepen, bijvoorbeeld);
- Drankverpakkingen van maximaal drie liter;
- Drinkbekers;
- Lichte kunststof draagtassen.
2024
Er komt in Nederland een verbod op het gratis verstrekken van plastic-bevattende voedselverpakkingen voor eenmalig gebruik met als doel het verbruik van dit soort verpakkingen blijvend te verminderen.
3 juli 2024
Er komt een nieuwe producteis voor kunststof flessen en bekers. Vanaf 3 juli 2024 moeten doppen vastzitten aan alle drankflessen van maximaal drie liter.
31 december 2024
De producentenverantwoordelijkheid wordt verder uitgebreid. Producenten dragen nu ook de kosten voor het opruimen van deze soorten zwerfafval:
- Vochtige doekjes (voor hygiëne en huishoudelijk gebruik);
- Ballonnen;
- Kunststof producten in de visserij.
2025 - 2030
Het gebruik van gerecycled plasticVanaf 2025 moeten PET-drinkflessen tot drie liter gemiddeld ten minste 25 procent gerecycled kunststof bevatten. Vanaf 2030 geldt voor alle plastic drinkflessen dat ze van minstens 30 procent gerecycled kunststof moeten zijn gemaakt.
Inzameling
Ook moet in 2025 minimaal 77 procent van alle plastic drinkflessen tot drie liter worden ingezameld. Vanaf 2029 moet dit minimaal 90 procent zijn. Nederland neemt een voorsprong op deze maatregelen door per 1 juli 2021 statiegeld te verplichten voor alle PET frisdrank- en waterflessen. Per 1 januari 2022 geldt een aparte inzameling van alle plastic drinkflessen. Producenten mogen hiervoor met elkaar samenwerken.
Producten waarbij je dit icoon vindt, vallen onder het verbod op plastic wegwerpproducten voor eenmalig gebruik.
Op producten waarbij je dit icoon ziet, moet straks een verplichte markering staan, die aangeeft of het product van plastic is gemaakt of plastic bevat.
Dit icoon vind je bij de plastic bevattende voedsel- en drinkbekerverpakkingen voor eenmalig gebruik die je niet meer gratis mag meegeven aan je klant.
